HAMBURG, N.Y. - Two men are in critical condition after they were hit by a vehicle that was rear-ended by an alleged drunk driver.
It happened around 11 p.m. on Route 5 near Milestrip Road in Hamburg.
Hamburg Police set up a road block following multiple accidents on the Milestrip Road overpass that were blamed on icy road conditions.
Police say a suspected drunk driver drove around a marked police vehicle with flashing lights, nearly striking the officer standing beside it.
The driver then rear-ended a vehicle that was involved in one of the previous accidents, and that car hit two men standing in front of it.
The 32-year-old and 61-year-old victims were taken to ECMC. Their names haven't been released.
The driver who hit them, Thomas Gilray,Jr., refused a breath test. He is charged with driving while intoxicated, vehicular assault, reckless endangerment, and failure to yield to an emergency vehicle.
